Terms of Service
These terms govern the professional business and consulting services provided by Client Acquisition Co. Pty. Ltd. (ABN 95 703 166 036).
1. About These Terms
These Terms of Service ("Terms") apply to all engagements with Client Acquisition Co. Pty. Ltd. (ABN 95 703 166 036), referred to in these Terms as "we", "us" or "our". By engaging our services, using our website at https://clientacquisitioncoltd.online, or entering into a service agreement with us, you agree to be bound by these Terms.
Where a signed service agreement or written proposal exists between you and us, the terms of that agreement prevail over these Terms to the extent of any inconsistency.
2. Our Services
We provide professional business and consulting services, including client acquisition strategy, business development support, sales process consulting, lead generation frameworks, and related advisory services. The specific scope, deliverables, timelines and fees for each engagement are set out in the relevant written proposal or service agreement.
Any indicative information provided on our website, in initial discussions or in marketing materials is general in nature and does not constitute a binding offer or a guarantee of specific business outcomes.
3. Quotes, Proposals and Commencement
Quotes and proposals provided by us are valid for 30 days from the date of issue unless otherwise stated. An engagement commences only when both parties have accepted the proposal in writing and any required deposit or initial payment has been received. Work performed outside the agreed scope may be quoted separately and will be invoiced upon written acceptance.
4. Fees, Invoicing and Payment
Fees are stated in Australian dollars and are exclusive of GST unless otherwise stated. Invoices are payable within 14 days of issue, or as otherwise specified in the service agreement. Late payments may attract interest and reasonable recovery costs. Where an engagement is terminated before completion, fees for work performed up to the date of termination remain payable.
5. Client Responsibilities
You agree to provide timely access to information, personnel, systems and approvals reasonably required for us to deliver the services. Delays caused by a failure to provide such access or information may affect agreed timelines and may result in additional fees where re-scheduling is required.
6. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), including consumer guarantees, or any other applicable Commonwealth, State or Territory legislation. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Where our services are not provided with due care and skill, are not reasonably fit for their stated purpose, or are not delivered within a reasonable time, you may be entitled to a remedy under that legislation.
To the extent permitted by law, our liability for any claim arising from the services is limited, at our option, to the resupply of the services or the payment of the cost of having the services resupplied.
7. Confidentiality and Intellectual Property
Each party will keep confidential the non-public information of the other party disclosed during an engagement. Unless otherwise agreed in writing, you retain ownership of your business information and we retain ownership of our methodologies, frameworks, templates and pre-existing materials. Deliverables created specifically for you under a paid engagement are licensed to you for your internal business use upon full payment.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, including loss of profit, revenue, goodwill or anticipated savings, arising from or connected to the services. Subject to section 6, our total aggregate liability for any claim is limited to the fees paid by you for the service giving rise to the claim.
9. Website Content
Content on this website is provided for general information about our services and business. It does not constitute financial, legal, taxation or other professional advice and should not be relied upon as such. You should obtain advice specific to your circumstances before acting on any information presented here.
10. Termination
Either party may terminate an engagement in accordance with the notice provisions of the applicable service agreement, or immediately if the other party commits a material breach that is not remedied within 14 days of written notice.
11. Privacy
Our collection, use and handling of personal information is described in our Privacy Policy. That policy forms part of these Terms.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be published on this page with the date of last revision. Continued engagement or use of our website after changes are published constitutes acceptance of the updated Terms.
